Terms of Service

These Terms of Service ("Terms") govern your use of linscp.net (the "Site") and the LinSCP open-source software distributed through it (the "Software"). The Site is operated by Trenton Tompkins ("we," "us," "our"). By using the Site or the Software, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or the Software.

1. What LinSCP Is

LinSCP is a native Linux port of WinSCP — a file-transfer client supporting SFTP, SCP, FTP, FTPS, WebDAV, and Amazon S3. The Software is free, open source, and distributed under the MIT License (see LICENSE). The upstream WinSCP project is separately licensed under GPLv3; components derived from WinSCP retain their GPLv3 obligations.

2. Eligibility

You must be at least 13 years old to use the Site. The Software is a developer/system-administration tool and is not directed at children under 13. If you are a parent or guardian and believe a child has provided us with personal information through the Site, contact legal@linscp.net.

3. License to the Software

The MIT License grants you broad rights to use, copy, modify, and redistribute the Software. The full license text is included in every release archive. You are responsible for complying with both the MIT License (for our code) and the GPLv3 (for any WinSCP-derived components). Nothing in these Terms restricts rights granted by those licenses.

4. Acceptable Use of the Site

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to probe, scan, or breach the security of the Site; (c) upload malware, exploits, or any content intended to damage or surveil other users; (d) scrape or mirror substantial portions of the Site without written permission; (e) misuse our issue tracker or download endpoints to overwhelm them with automated traffic.

5. User Submissions (GitHub, Issues, Discussions)

If you submit code (pull requests), issue reports, or discussion posts to our GitHub repository, you grant the project a non-exclusive, worldwide, royalty-free license to use, modify, and redistribute your contribution under the project's MIT License. You represent that you have the rights to grant that license. Issue posts that are abusive, off-topic, or in violation of GitHub's terms may be locked or deleted.

6. SMS Communications (10DLC / TCR)

LinSCP does not currently send SMS messages. The Site is not a messaging service. The following terms describe what would apply if and when SMS notifications are added (for example, release announcements or security advisories).

7. Email (CAN-SPAM)

Any commercial email sent from this Site will comply with the CAN-SPAM Act of 2003: a valid physical mailing address, clear identification as an advertisement (where applicable), an honored unsubscribe link, and accurate "From" and "Subject" headers. To opt out, click the unsubscribe link in any email or email legal@linscp.net.

8. No Warranty / "As Is"

The Site and the Software are provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site or the Software will be uninterrupted, secure, error-free, or free of viruses or other harmful components. Use of LinSCP to transfer files is at your own risk; verify backups before any destructive operation (delete, overwrite, synchronize).

9. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising from your use of the Site or the Software is limited to USD $0 (the price you paid). We are not liable for indirect, incidental, consequential, or punitive damages, including lost data, lost profits, or business interruption.

10. Indemnification

You agree to defend and indemnify Trenton Tompkins and the LinSCP project against any claim arising from your violation of these Terms, your misuse of the Site or the Software, or your transfer of unlawful content.

11. Third-Party Services

The Site links to and integrates with third parties, including GitHub (source code, releases, issue tracking) and the upstream WinSCP project (source materials). Your use of those services is governed by their own terms and privacy policies.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on this page with a new effective date. Continued use of the Site after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law principles. Disputes will be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania.
